Parking Regulations

Brookscroft Parking Regulations November 2006

Brookscroft is a private residential estate and the freehold interest in amenity lands is vested in Brookscroft Management Ltd (BML). The Brookscroft Covenant requires BML to "make and enforce such regulations (if any) as it may in its absolute discretion consider necessary or desirable to enable all residents on the Estate to enjoy the amenity lands". In accordance with this requirement, BML makes the following Regulations in relation to the parking of vehicles in Brookscroft:

1. General
Plotholders, their tenants and their visitors
- should park motor vehicles in garages or on their own driveway wholly within their own property;
- may park motor vehicles on amenity lands subject to the following conditions

a) Vehicles must at all times (subject to (e) below) be in a roadworthy condition and display a current tax disk.
b) Parking is permitted in designated spaces demarcated by white lines. A vehicle must be parked wholly within a space.
c) Parking outside designated spaces is only permitted if the relevant permit is displayed in the vehicle (see Commercial Vehicles and Permits below).
d) Parking is not permitted in any one space for more than 16 days continuously without the written permission of BML.
e) Maintenance or servicing of vehicles is not permitted other than normal servicing of private cars belonging to residents.
f) Residents of house numbers 3 - 7 and 36 - 38 may park or allow their visitors to park on the section of driveway in front of their properties between the footpath and the road.

2. Obstruction
Vehicles must not:
- Be parked in a way likely to cause an obstruction, or to hinder residents' rights of access to their own garages;
- Be parked wholly or partly on grass verges;
- Wholly or partly obstruct footpaths or pavements on the amenity lands.

3. Commercial vehicles
Commercial vehicles, including car derived vans, lorries, caravans, horse-boxes, trailers, mobile homes and boats, may not be parked in any part of the Estate except to deliver goods or services to Estate residents or in connection with the upkeep of amenity lands.

Commercial vehicles with bona-fide business on the Estate must

- be parked in a marked bay if availability and the size of the vehicle so permit;
- otherwise, be parked so as to minimise inconvenience or obstruction;
- display a Brookscroft Commercial Vehicle Permit which shows the Brookscroft property where the driver may be contacted, or display a Brookscroft Estate Contractor's Permit. If asked to do so because his vehicle is causing inconvenience, a driver must move the vehicle immediately.

Delivery vans and licensed taxi cabs staying less than ten minutes on the Estate are not required to display the permit, but otherwise must comply with these Regulations. Deliveries and collections must be made between 7.00 am and 10.00 pm.

Emergency vehicles are exempt.

4. Permits
BML may at its discretion issue Permits which allow an exception to these Regulations. It will do so when it considers that the exception benefits residents of the Estate, and that it is compatible with the obligations placed on both BML and plotholders by the Brookscroft Covenant.

Specific conditions will be attached to any Permit issued. A breach of those conditions will be considered as a breach of these Regulations.

5. Non-compliance
Any vehicle parked on the Estate not in accordance with these Regulations may be:
- clamped or removed;
- subject to a penalty to be settled by the owner of the vehicle.

Decisions on the level of penalties and the choice of appropriate sanction in any particular instance are at the discretion of BML's clamping contractors.
